1. Who we are

forttroff.com ("forttroff.com", "we", "us") is a California limited liability company at 18047 Beach Blvd, #225, Huntington Beach, CA 92648, United States, and is the legal party to every order. By using forttroff.com or placing an order, you agree to these Terms of Service, our Privacy Policy, and any policy linked from this page. If you do not agree, please do not use the site.

2. Eligibility and age

forttroff.com sells adult products intended for adults. To access the site, create an account, or place an order, you must meet the minimum legal age to view and buy adult products under the laws of the country, state, province, or territory where you live. That age is 18 in most places and higher in some. By using the site you confirm that you meet this requirement and that viewing and purchasing adult products is lawful where you are.

We may ask for proof of age or identity before accepting or shipping an order and may cancel any order where we cannot verify it.

3. Orders, pricing, and payment

Online only. We do not operate a physical storefront. All purchases are made at forttroff.com.

Your order is an offer. Placing an order is an offer to purchase. A contract forms when we ship the products and send a shipping confirmation. We may decline or cancel an order for any lawful reason, including suspected fraud, pricing or listing errors, stock shortages, or shipping restrictions. If we cancel an order you have already paid for, we refund the amount charged.

Pricing. Prices are shown in US dollars unless a local currency is displayed. Prices exclude taxes, duties, and shipping unless stated otherwise at checkout. We work hard to keep listings accurate; if a product is listed at an incorrect price, we may cancel the order and let you know before charging or by issuing a full refund.

Payment. Payment is collected at checkout through our payment processors. By submitting payment you confirm you are authorized to use the payment method. See Secure Payments and Discreet Billing for how charges appear on your statement.

Promotions and store credit. Discount codes, promotions, and store credit are subject to the terms shown with them and cannot be exchanged for cash.

Taxes and duties. Sales tax is applied where required. International orders are shipped duties unpaid; any import duties or taxes assessed by your country are paid by you at delivery.

4. Shipping, returns, and guarantee

Delivery times, costs, and destinations are described in our Shipping Policy. Exchanges, store credit, defective items, and your statutory rights are described in our Returns and Exchanges policy, which includes our Satisfaction Guarantee and the Right of Withdrawal (EU and UK). Both policies form part of these Terms.

Risk of loss passes to you when the carrier delivers the parcel to the address you provided.

5. Accounts and communications

You are responsible for keeping your account credentials confidential and for activity under your account. Tell us right away at info@forttroff.com if you suspect unauthorized use.

Email and SMS. When you opt in, we send marketing by email and text message. You can unsubscribe from email at any time using the link in any message, and you can stop texts by replying STOP. Text messaging is governed by our SMS Terms and Conditions, which are part of these Terms. Consent to marketing is never a condition of purchase.

6. Reviews and user content

You may be able to post reviews, questions, photos, or other content ("User Content"). You keep ownership of your User Content and grant forttroff.com a worldwide, royalty-free, non-exclusive license to use, reproduce, display, and distribute it in connection with forttroff.com and our marketing, in any media, for as long as it remains on the site or in our records. You confirm your User Content is your own, is accurate, is not misleading, and does not infringe anyone's rights or show any person without their consent.

Honest reviews. We publish reviews from real customers and treat positive and negative reviews the same way. We do not offer compensation for a review of a particular sentiment and we do not suppress reviews because they are critical. We may remove content that is unlawful, off-topic, abusive, contains personal information, or violates these Terms.

Takedown requests. If you believe content on the site infringes your copyright, follow the process on our DMCA Policy page.

7. Intellectual property

forttroff.com, its design, text, photography, video, graphics, logos, and product descriptions are owned by or licensed to forttroff.com and protected by copyright, trademark, and other laws. FORT TROFF is a registered trademark of forttroff.com. You may browse the site and print pages for personal, non-commercial use. Any other use, including scraping, reproduction, or use of our trademarks, requires our written permission.

Automated access. Search engines, AI assistants, and shopping agents may index public pages of forttroff.com to help adults find our products. Bulk extraction of product data, pricing, or images for resale, model training on our photography, or any access that burdens the site is not permitted without a written license. 8. Acceptable use

You agree not to use the site to break any law, infringe anyone's rights, submit false information, interfere with the site's security or operation, place fraudulent orders, or resell our products in a way that misrepresents your relationship with us. We may suspend or close accounts and cancel orders where these Terms are breached.

9. Disclaimers and liability

Product use. Our products are for adult personal use. Please follow the product instructions and care guidance and use products as intended. Product descriptions and any wellness or educational content on the site are provided for general information and are not medical advice.

Site provided as is. To the fullest extent permitted by law, forttroff.com and its content are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise the site will be uninterrupted or error-free.

Limitation of liability. To the fullest extent permitted by law, forttroff.com and its owners, employees, and partners are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising from your use of the site or products purchased through it. Our total liability for any claim relating to an order is limited to the amount you paid for that order.

Your rights are protected. Nothing in these Terms excludes or limits liability that cannot be excluded by law, including liability for death or personal injury caused by negligence, fraud, or your rights as a consumer under the laws of your country or state. Consumers in the EU, UK, Australia, and Canada have statutory rights described in Regional terms and on our Returns and Exchanges page.

Indemnity. You agree to indemnify forttroff.com against claims, losses, and expenses (including reasonable attorneys' fees) arising from your breach of these Terms or your misuse of the site.

10. Disputes and arbitration

Let us fix it first. Most issues are solved in one email. Before starting any formal dispute, please write to info@forttroff.com with your order number and a description of the problem, and give us 30 days to respond.

Governing law. These Terms are governed by the laws of the State of California and applicable United States federal law, without regard to conflict-of-law rules, except where the mandatory consumer protection law of your place of residence provides otherwise.

Binding arbitration. Any dispute, claim, or controversy arising from these Terms, the site, or any purchase that is not resolved informally will be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The Federal Arbitration Act governs this section. The arbitrator may award the same individual relief a court could. Arbitration may be conducted by video, phone, or written submissions, and any hearing will take place in Orange County, California, or a location we agree on. forttroff.com will pay arbitration filing fees for consumer claims to the extent required by the AAA rules.

Class action waiver. You and forttroff.com agree to bring claims only in an individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate claims of more than one person.

Exceptions. Either party may bring an individual claim in small claims court, and either party may seek injunctive relief in court for infringement or misuse of intellectual property.

30-day opt-out. You may opt out of this arbitration agreement by emailing info@forttroff.com with the subject "Arbitration Opt-Out", your name, and the email address on your account, within 30 days of your first purchase. Opting out does not affect any other part of these Terms.

Court venue. If arbitration does not apply for any reason, you agree to the exclusive jurisdiction of the state and federal courts located in Orange County, California, except where the mandatory law of your residence gives you the right to bring proceedings in your local courts.

11. Regional terms

European Union and United Kingdom

If you are a consumer in the EU or UK, you have a 14-day right to cancel most orders for unopened, sealed products, and a legal guarantee that products conform to their description. Sealed products that have been unsealed cannot be returned for hygiene and health reasons once opened. Details and the model cancellation form are on our Right of Withdrawal (EU and UK) page. Nothing in these Terms affects those rights. The arbitration section applies to you only to the extent permitted by the law of your country. Under the EU Digital Services Act, our single point of contact for authorities and users is info@forttroff.com.

Australia

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these Terms limits those guarantees. Our Satisfaction Guarantee operates in addition to them.

Canada

If you are a consumer in Canada, provincial consumer protection legislation gives you rights that cannot be waived, including implied warranties of quality. Nothing in these Terms limits those rights.

12. General terms

Changes. We may update these Terms from time to time. The effective date at the top of the page shows the current version, and continued use of the site after a change means you accept the updated Terms. Material changes affecting pending orders will not apply to those orders.

Entire agreement and severability. These Terms, together with the policies linked from this page, are the entire agreement between you and forttroff.com regarding the site. If any part is found unenforceable, the rest remains in effect.

No waiver and assignment. Our failure to enforce any provision is not a waiver. We may assign these Terms to an affiliate or successor; you may not assign them without our consent.

Force majeure. We are not responsible for delays or failures caused by events outside our reasonable control, including carrier disruptions, customs delays, strikes, natural disasters, or outages.

Export and sanctions. You agree to comply with applicable export and sanctions laws and confirm that you are not located in, and will not ship products to, a country or person subject to comprehensive US sanctions.

Do these Terms override my consumer rights in the EU, UK, Australia, or Canada?
